Elevate Performance & Recovery · Berlin, New Hampshire
Membership Agreement
Group training three mornings and afternoons a week, plus your own key code for the recovery room. Month to month. Cancel whenever you want.
1. What you're signing up for
This is an agreement between Elevate Performance & Recovery ("Elevate") and you, the member. It starts on the day you sign and continues month to month until you or Elevate cancel it.
2. Classes
Classes run Monday, Wednesday and Friday. You may attend any class, as many times per week as you like — there's no assigned time slot.
Elevate may adjust class times, cancel individual sessions for weather, holidays or illness, and change the coaching schedule. If class times change in a way that no longer works for you, you can cancel under Section 5.
3. Recovery amenities
Your membership includes use of the red light panel, infrared sauna, NormaTec compression sleeves and cold plunge on three days of your choosing each week. Those days do not have to be class days.
You'll receive a personal door code so you can use the recovery room 24 hours a day, including when no staff are present.
Your door code
- The code is yours alone. Don't share it, write it down where others can see it, or let anyone in behind you.
- No guests, no family members, no children — only you.
- If you share your code or admit someone else, your membership ends immediately and you're responsible for any injury, loss or damage that results.
- Lock the door behind you when you leave.
Elevate may take equipment offline for maintenance or repair. Amenity availability is not guaranteed and no credit is issued for downtime.
The facility is monitored by video surveillance in common areas for security purposes.
4. Payment
- $109 per month. Your first payment is due today, at the link at the bottom of this page.
- The day you sign up becomes your billing date. Sign up on September 7 and every payment after that is due on the 7th.
- Josh emails your invoice about a week ahead of that date, so you have it in hand before it's due.
- If the invoice isn't paid by your billing date, your classes and door code are suspended until it's settled. This is applied to every member the same way.
- If your billing day doesn't exist in a given month — the 31st, for instance — payment is due on the last day of that month.
- Elevate may change the price with 30 days' notice by email. You can cancel before the new rate takes effect.
5. Cancelling
Cancel any time. Email josh@elevatenh.com or text 603.803.3238 before your next billing date, and you won't be billed again. Your classes and door code stay active through the end of the month you've already paid for.
Payments already made aren't refunded or prorated. Elevate may end your membership at any time for unsafe conduct, non-payment, or violation of this agreement; if that happens, any unused portion of the current month is refunded.
6. Using the recovery room without staff present
Heat, cold and compression carry real risk, and you'll often be using them alone. Read this part carefully — you're agreeing to follow it.
Never hold your breath in or near the cold plunge, and never submerge your head. Breath-hold work in cold water can cause you to lose consciousness without warning.
- Tell someone when you're going in the sauna or the plunge, and keep your phone within reach.
- Don't use the sauna, plunge or any equipment after drinking alcohol or taking anything that affects alertness, judgment or your sense of heat and cold.
- Sauna: drink water beforehand, start short, and get out if you feel lightheaded, nauseated or your heart is racing. Don't exceed 30 minutes.
- Cold plunge: get in and out under your own power, keep sessions brief, and get out at the first sign of numbness, shivering you can't control, or chest tightness.
- Don't use the compression sleeves if you have a blood clot or history of clots, a recent fracture, an open wound, an infection, or numbness in the limb.
- Stop and leave if any equipment appears damaged, and tell Josh.
- If something goes wrong, call 911 first, then Josh at 603.803.3238.
You agree to use the amenities only during your own visit, only as instructed, and never to let another person use them on your code.
7. Health and medical clearance
You confirm that you're physically able to participate in exercise and to use heat, cold and compression therapy, and that you've talked to a physician if you have any reason to think you shouldn't.
Tell Josh before you start if any of the following apply: heart disease or an irregular heartbeat, high or low blood pressure, a history of stroke, fainting or seizures, diabetes, pregnancy, blood clots, Raynaud's, cold urticaria, a nerve or circulatory condition, recent surgery, or any medication that affects your heart rate, blood pressure, circulation or ability to sense temperature. Update Josh if your health changes during your membership.
Elevate is not a medical provider. Nothing here is medical care, diagnosis or treatment, and it doesn't replace advice from your own physician.
8. Assumption of risk and release
You understand that strength and conditioning training, group exercise, sauna and heat exposure, cold water immersion, pneumatic compression, red light therapy, and the general use of a gym facility involve inherent risks — including muscle strain, sprains, fractures, heat illness, dehydration, fainting, cold shock, cardiac events, permanent disability and death. You accept those risks knowingly and voluntarily, whether they arise from the activity itself, the condition of the facility or equipment, the conduct of other members, or the ordinary negligence of Elevate.
To the fullest extent allowed by New Hampshire law, you release and hold harmless Elevate Performance & Recovery, Joshua Tamblyn, and their employees, contractors, agents and property owner from any claim, demand, loss or liability for injury, illness, death or property damage arising out of your membership, your use of the facility or amenities, or your presence on the premises — including during unstaffed hours. You agree to indemnify them against any claim brought by anyone who gains access to the facility using your door code.
This release does not apply to gross negligence or willful misconduct. If any part of this agreement is found unenforceable, the rest stays in effect.
9. Conduct and property
- Wipe down equipment and return it where it belongs.
- Shower before the sauna or plunge, and follow the posted cleaning steps after using the plunge.
- Elevate isn't responsible for lost, stolen or damaged personal property.
- You're responsible for damage you cause to the facility or equipment through misuse.
10. General
This is the entire agreement between you and Elevate, and it replaces anything discussed beforehand. It's governed by the laws of the State of New Hampshire. Membership is personal to you and can't be transferred or shared. Elevate may update these terms with 30 days' notice by email; continuing your membership after that means you accept the update.
